DEFINITIONS

For the purposes of this Agreement, "Casino" means Elements Casino Victoria and all its affiliated businesses; "Member" means a person who has applied to be a member of the Casino's loyalty program or has registered for a gaming account with the Casino; "Gameplay" includes any form of gambling activity conducted on the premises of the Casino or through authorized mobile applications; and "User" means an individual who accesses the Casino's website, mobile application or enters the physical casino.

USE OF THE CASINO

By accessing the Casino's website or entering its physical premises, User acknowledges that they have read, understood and agree to be bound by these Terms and Conditions ("Agreement"). The Casino reserves the right to modify any provision of this Agreement at any time without prior notice.

ELIGIBILITY TO GAMBLE

The following individuals are not eligible to gamble with the Casino:

• Minors (persons under 19 years old);
• Self-excluded persons;
• Excluded persons by order of law or regulatory authority.Any individual found to be ineligible shall have their account suspended and/or gaming privileges revoked.

RESPONSIBLE GAMBLING PRACTICES

The Casino is committed to promoting responsible gambling practices among its patrons. User acknowledges that they will use the Casino's resources (such as deposit limits, session time-out features) and tools provided by regulatory authorities (like GameSense) to maintain a healthy relationship with gaming.

RIGHT TO REFUSE SERVICE

The Casino reserves the right to refuse service to any person at any time without explanation or notice.

ACCOUNTS AND GAMING CREDITS

• Member accounts are personal to the individual and may not be used by others;
• Gaming credits are non-transferable and are valid only for gameplay with the Casino.Any attempt to transfer, sell or otherwise distribute gaming credits shall result in account suspension and/or privileges revoked.

WINNING AND LOSING LIMITS

• The maximum win on any single bet is $100,000;
• No single payout may exceed $100,000 per calendar year;
• If a player wins an amount exceeding the applicable limit(s), such excess shall be forfeited in favour of the Casino.

ACCOUNT SECURITY AND CONFIDENTIALITY

User acknowledges that they will keep their account information and passwords confidential and secure at all times.

GOVERNING LAW

These Terms and Conditions are governed by the laws of British Columbia, Canada.

JURISDICTIONAL VENUE

• All disputes arising out of or in connection with these Terms and Conditions shall be resolved through arbitration in accordance with the Arbitration Act (British Columbia);
• The courts of British Columbia have exclusive jurisdiction over any claims between User and Casino.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding of parties relating to use of the Casino, supercedes all prior negotiations or discussions, and may only be amended by written agreement signed by both parties.

HEADINGS

• Headings in this Agreement are for convenience purposes only;
• They do not affect construction or interpretation of these Terms and Conditions;

DEFINITIONS OF GAMING AND OTHER TERMS

For the purposes of this Agreement "Casino Games" includes all forms of gaming conducted on premises including slots, table games (poker, blackjack, roulette), electronic tables; "Gaming Account" means an account established by User to play Casino Games with gaming credits;"Gaming Credit" is a virtual unit used for playing Casino Games.

DEFINITIONS OF TECHNICAL TERMS

For the purposes of this Agreement "Browser" means any software application designed for accessing, viewing and interacting with web pages; "Certificate Authority", for example DigiCert, GlobalSign or Let’s Encrypt issued to secure traffic between user browser and website;"Customer Support", services provided by the Casino including Guest Services telephone contact and written communication via email.

GOVERNING DOCUMENTS

These Terms and Conditions are incorporated into, supersede all prior communications and become effective as of acceptance in writing or when User uses its service(s) at the physical location after posting online on website; any reference to other documents (instruments, policies, regulatory agreements) shall be binding upon parties.

NOTICES

• For purposes of this Agreement notices given by email shall be sufficient;
• Notices given through the Casino’s mobile application, or posted on its website shall also constitute a valid notice;

COMPLETENESS AND MODIFICATIONS

These Terms and Conditions constitute the entire understanding between parties relating to the use of the casino; no waiver or failure by either party at any time to enforce a right or require performance under this Agreement shall be considered an amendment or modification, nor in and of itself waive such requirement.

ACKNOWLEDGEMENT

User acknowledges that they have read these Terms and Conditions carefully, understand their content, agree with them, and are familiar with the rules governing gambling activities within British Columbia.
